Welcome to FlashModeLearn. These Terms of Service ("Terms") govern your access to and use of our platform and services available at flashmodelearn.com and our mobile applications (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

Please read these Terms carefully before using our Service. If you do not agree to these Terms, you may not access or use the Service.

1. Eligibility and Age Requirements

1.1 Minimum Age

You must be at least 13 years of age to use this Service. If you are under 18 years of age (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use the Service and they must agree to these Terms on your behalf.

1.2 European Union Users

If you are located in the European Union, European Economic Area, or the United Kingdom, you must be at least 16 years of age to use this Service without parental consent. Users between 13-16 years of age require verifiable parental consent in accordance with the General Data Protection Regulation (GDPR).

1.3 COPPA Compliance (United States)

In compliance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13 without verifiable parental consent. If you believe a child under 13 has provided us with personal information, please contact us at privacy@flashmodelearn.com.

2. Account Registration

To access certain features of the Service, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

By creating an account, you represent and warrant that you meet the age requirements stated in Section 1.

3. Subscription and Billing Terms

3.1 Free and Premium Plans

FlashModeLearn offers both free and premium subscription plans. The free plan provides limited access to features. Premium subscriptions unlock additional features and capabilities as described on our pricing page.

3.2 Subscription Fees and Billing

Premium subscriptions are available on a monthly or yearly basis. Current pricing is displayed on our pricing page. All fees are charged in Euros (EUR) unless otherwise specified.

• Monthly Plan: €9.99 per month
• Yearly Plan: €79.99 per year (approximately €6.67 per month)

Prices are subject to change. We will notify you of any price changes before they take effect.

3.3 Automatic Renewal

IMPORTANT: Premium subscriptions automatically renew at the end of each billing period (monthly or yearly) at the then-current subscription rate, unless you cancel before the renewal date. You authorize us to charge your payment method on file for each renewal period until you cancel.

3.4 Payment Processing

All payments are processed securely by Stripe, Inc. By providing your payment information, you authorize us (through Stripe) to charge your payment method for all fees incurred. We do not store your complete credit card information on our servers.

3.5 Taxes

Subscription fees may be subject to applicable taxes (including VAT for EU customers), which will be calculated and collected at checkout based on your location.

4. Cancellation and Refunds

4.1 How to Cancel

You may cancel your Premium subscription at any time through your account settings or by contacting us at support@flashmodelearn.com. Cancellation will take effect at the end of your current billing period, and you will retain access to Premium features until then.

4.2 Right of Withdrawal & Refund Policy

14-Day Money-Back Guarantee (Commercial)

In addition to any statutory rights, we offer a 14-day money-back guarantee for new Premium subscriptions. If you are not satisfied, you may request a full refund within 14 days of your initial purchase by contacting us at support@flashmodelearn.com.

After the 14-day period:

• Refunds may be issued at our discretion for technical issues we cannot resolve
• No refunds will be issued for change of mind after 14 days
• Refunds are processed within 5-10 business days

4.3 Effect of Cancellation

Upon cancellation, your account will revert to the free plan. Your vocabulary data and learning progress will be preserved, but access to Premium features will be restricted. You may re-subscribe at any time.

5. User Content

5.1 Content You Upload

Our Service allows you to upload images and audio files for vocabulary extraction. You retain ownership of any content you upload ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process, store, and analyze the content solely to provide the Service to you.

5.2 Your Responsibilities

You are solely responsible for User Content and represent that:

• You own or have the necessary rights to upload the content
• The content does not infringe any third-party intellectual property rights
• The content does not contain illegal, harmful, or objectionable material

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or applicable law. Processing job data is automatically deleted after 7 days.

6. Intellectual Property

All content, features, functionality, trademarks, logos, and materials on FlashModeLearn (excluding User Content) are the property of FlashModeLearn or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, modify, or distribute any content without our prior written permission.

7. Acceptable Use Policy

You agree not to:

• Violate any applicable laws or regulations
• Infringe the intellectual property or privacy rights of others
• Upload content that is illegal, harmful, threatening, abusive, or defamatory
• Attempt to gain unauthorized access to our systems or other users' accounts
• Distribute malware, viruses, or other harmful code
• Engage in spamming, phishing, or other deceptive practices
• Use automated systems (bots, scrapers) to access the Service without permission
• Interfere with or disrupt the Service or its infrastructure
• Circumvent any security measures or access restrictions

8. Copyright Infringement (LPI / DMCA)

We respect the intellectual property rights of others. If you believe that content on our Service infringes your copyright, please send a notice to our designated agent at legal@flashmodelearn.com including:

• Identification of the copyrighted work claimed to be infringed
• Identification of the allegedly infringing material and its location
• Your contact information (address, phone number, email)
• A statement that you have a good faith belief the use is unauthorized
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

Jurisdictional note: FlashModeLearn is operated from Spain and is primarily subject to Spanish intellectual property law (Real Decreto Legislativo 1/1996, Ley de Propiedad Intelectual — LPI) and EU copyright directives. The notice format above follows internationally recognised practice. We process all good-faith copyright notices regardless of their jurisdictional basis.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy, completeness, or usefulness of any content, including vocabulary translations generated by our AI systems.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY MANDATORY APPLICABLE LAW, FLASHMODELEARN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Certain statutory liabilities cannot be limited or excluded by contract, including those arising under EU mandatory consumer protection law (including the Digital Content Directive and applicable product liability law) and the GDPR. Nothing in these Terms limits liability for gross negligence, wilful misconduct, or fraud. The foregoing limitations apply only to the fullest extent permitted by mandatory applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless FlashModeLearn and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms, except to the extent caused by our own negligence, wilful misconduct, or breach of applicable law.

12. Termination

We may immediately suspend or terminate your account for serious or material breaches of these Terms, including fraudulent activity, illegal conduct, or repeated violations. For less serious breaches, we will generally provide notice and a reasonable opportunity to remedy the breach before taking action. Upon termination:

• Your right to use the Service will immediately cease
• You may request a copy of your data before termination takes effect
• Provisions that should survive termination will remain in effect

You may terminate your account at any time by following the account deletion process in your settings.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and may delete your account at any time from your account settings.

For significant changes, we will provide at least 30 days' notice before the new terms take effect.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law principles.

For users in the European Union: You may also be entitled to bring claims before the courts of your country of residence under applicable consumer protection laws.

Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the courts of Barcelona, Spain shall have primary jurisdiction, without prejudice to any mandatory right you may have as a consumer to bring proceedings before the courts of your country of residence.

Online Dispute Resolution (EU): If you are a consumer located in the European Union, you may also use the EU Online Dispute Resolution (ODR) platform to resolve disputes with us, in accordance with EU Regulation 524/2013: https://ec.europa.eu/consumers/odr. 15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and FlashModeLearn.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
• Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
• Assignment: You may not assign these Terms without our prior written consent. We may assign our rights and obligations under these Terms.
